Thank you for using SureShot to create unforgettable experiences around events.

  1. Joining the SureShot movement
    1. These user terms (“Terms”) are a binding legal agreement between you and SureShot that govern your use of the SureShot Websites and App (collectively, the “Platform”). In these Terms, the words “SS”, “SureShot”), “we”, “us” and “our” refers to SureShot ApS, CVR-no. 44913089, Havneholmen 30 st.tv, DK-1561 Copenhagen V, Denmark with whom you are contracting. By accessing or using any part of the Platform, you accept, without limitation or qualification, these Terms. If you do not agree with these Terms, you are prohibited from using any portion of the Platform. The registration of an Account (as defined below) requires your express acceptance of these Terms.
    2. To support the goal we try to keep it simple and we provide an easy concept by which we empower creators, like you, that use our app (“App”), collectively (“users”) (in these user terms we refer to you as “you” or “user”) to co-record videos when attending events made by event makers (“Event Makers”) and share video clips with other users of the App . Our App helps attend events, record and upload videos.
    3. As you use our App keep in mind that SureShot is not responsible for any of the events you attend or the connectivity at any given location.

  2. What’s covered in these Terms
    1. We are on a mission to make it easy for creators and event makers to source crowd generated content (CGC) and enable fans to re-experience events through curated fan content.
    2. These Terms reflect the way that SureShot works and among other things, the obligations that apply to our relationship with you. As a result, these Terms help define our relationship with you as you interact with us and use our Platform. For example, these Terms include:
      1. What you can expect from us and the Platform.
      2. What we expect from you, which establishes certain rules for using our App.
      3. What to expect from Event Makers, which covers the basics of the interaction between you and Events on our App.
    3. Understanding these Terms is important because, by using the Platform you’re agreeing to these Terms. These Terms include all operating policies that are referred to herein (as such policies may be amended from time to time), including without limitation our Cookie Policy and our Privacy Policy that applies in your area.
    4. By accepting these Terms, you confirm that you have read and accepted our Privacy Policy.

  3. Using The SureShot App
    1. How to co-record videos during an event and get access to content from others in 7 easy steps:
      1. SureShot provides a simple app that enables you to co-record videos together with the event maker and watch content that other users from the same event have shared.
      2. You download the App and register as a user by using email or a 3rd party registration method like gmail, apple id, Facebook etc.
      3. Go through the onboarding and accept permission to use your camera, microphone, location and send notifications.
      4. To access and co-record at an event please insert the pin code that you have received from the event maker.
      5. You will be able to record video using the App during the event. Videos will be uploaded automatically.
      6. After the event there will be a window of opportunity to publish recorded videos to the event maker.
      7. If you share content during the event, you will get access to content from other users that attended after the event is over.
    2. You should never:
      1. Publish videos that have not been recorded by you during the event. If you do so you may get banned from using SureShot.
    3. User Account: Your SureShot user account is where you manage the details of your relationship with us and use the App to record videos in collaboration with event makers. You must register and create an account by providing us with all the information we require during account registration or anytime after (“Account”) on the App. You must keep your Account information complete, accurate and updated. Any failure to provide or maintain this information may interfere with our ability to provide our services to you.
    4. You should never:
      1. Select or use as a username a name of another person with the intent to impersonate that person.
      2. Use as a username a name subject to any rights of a person other than you without appropriate authorization.
      3. Use as a username a name that is otherwise offensive, vulgar or obscene.
      4. To access and co-record at an event please insert the pin code that you have received from the event maker.
      5. Use another person’s Account or registration information.
      6. Share your Account with others.
      7. Publish, distribute or post login information for your Account or another’s.
    5. Event Maker Account
      1. If you are representing a business you have the option to create an Event Maker Account (“Event Maker Account”).
      2. If you create an Event Maker Account you will need to provide additional information about your business.
      3. Your Event Maker Account will need to be approved by the SS customer success team before it will be available.
      4. Signing up for an Event Maker Account can be done through the App, Website or by contacting customer service or the SS partnership or customer success team.

  4. Events
    1. As a user you are able to create events and invite other SureShot users to join the event. When you do so you are the Event Maker.
    2. Depending on your subscription tier you will get access to additional features that will help you tag, curate and edit clips published in your event. You may also be able to use a desktop computer to manage and review the published clips.
    3. Creating an event is easy and can either be done through the App or web-based admin:
      1. Create an event, give it a name, description, start and end time, publishing window and location.
      2. Share the pin code generated with your audience.
      3. Activate your audience to help co-create videos through email, flyers, announcements etc.
      4. Wait until the event has ended and review the content published through the app or web-admin associated with your account.
      5. Mark the videos that should be available for the members of the event.
      6. Select and download the videos you want to use for edits.

  5. Content and rights management
    1. When you, as a user, record videos using the App, you have the full rights to the original video you have recorded.
    2. When you, as an event creator, publish videos through SureShot or externally, you will only publish content that has been curated, moderated, approved and does not violate these terms.
    3. If you choose to publish a video in an event you will have two options:
      1. If you want to see videos from other members that attended the event you will need to publish a copy of your original video. Publishing is happening automatically so, and will, give the event maker and SureShot full rights to use that copy.
      2. In case you want to reclaim your copy it will have to be done within 12 hours. Once the reclaim window is over the ownership of the copy can no longer be reclaimed and it belongs to the event maker.
    4. Users - You should never:
      1. Publish videos that have not been created by you.
      2. You should not publish videos that have not been recorded during the event you are attending.
      3. Publish inappropriate videos, including videos that contain violence, sex, rude language or something that may harm someone.
      4. Publish content of other people that have not given their consent to be filmed by you.
      5. SureShot can never be held reliable to be responsible for the content of the videos that you publish. Violating the terms of publishing videos may lead to banning of your Account and deletion of any content copy.
    5. Event Creators - You should never:
      1. Publish videos through SureShot or externally that have not been created by users attending the event.
      2. Publish videos through SureShot or externally that have not been recorded during the event you are organizing or partnering with.
      3. Publish inappropriate videos through SureShot or externally, including videos that contain violence, sex, rude language or something that may harm someone.
      4. SureShot can never be held reliable to be responsible for the content of the videos that you publish. Violating the terms of publishing videos may lead to banning of your Account and deletion of any content copy.
    6. SureShot may at any time remove any type of content from the user or event creator account without giving any reason.

  6. Subscriptions, and refunds
    1. SureShot may offer products and services for purchase through the App Store, Google Play, or other external services authorized by SureShot (each, an "External Service," and any purchases made thereon, an "External Service Purchase"). SureShot may also offer products and services for purchase via credit card or other payment processors on the Website or inside the App ("Internal Purchases"). If you purchase a subscription, it will automatically renew until you cancel, in accordance with the terms disclosed to you at the time of purchase, as further described below. If you cancel your subscription, you will continue to have access to your subscription benefits until the end of your subscription period, at which point it will expire.
    2. Because our services may be utilized without a subscription, canceling your subscription does not remove your profile from our services. If you wish to fully terminate your membership, you must terminate your membership as set forth in section 7.
    3. SureShot operates a global business, and our pricing varies based on a number of factors. We frequently offer promotional rates - which can vary based on region, length of subscription, bundle size, past purchases, account activity, and more. We also regularly test new features and payment options. In the event of a price change, we will attempt to notify you in advance of the change by sending an email and/or other communication message to the contact information you have registered for your account. If you do not wish to accept a price change for a renewing subscription, you may cancel your subscription in accordance with the instructions included in that communication and below. If you do not timely cancel your subscription, your subscription will be renewed at the price in effect at the time of the renewal, without any additional action by you, and you authorize us to charge your payment method for these amounts. To the extent permissible by law, we reserve the right, including without prior notice, to limit the available quantity of or discontinue making available any product, feature, service or other offering; to impose conditions on the honoring of any coupon, discount, offer or other promotion; to bar any user from making any transaction; and to refuse to provide any user with any product, service or other offering.
    4. EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONS: External Service Purchases, including subscriptions, may be processed through the External Service, in which case those purchases must be managed through your External Service Account. Subscriptions automatically renew until you cancel.
      1. When making a purchase on the service, you may have the option to pay through an External Service, such as with your Apple ID or Google Play account ("your External Service Account"), and your External Service Account will be charged for the purchase in accordance with the terms disclosed to you at the time of purchase and the general terms applicable to your External Service Account. Some External Services may charge you sales tax, depending on where you live, which may change from time to time.
      2. If your External Service Purchase includes an automatically renewing subscription, your External Service Account will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, the subscription will automatically continue for the price and time period you agreed to when subscribing. If you received a discounted promotional offer, your price may go up per the terms of that offer following the initial subscription period for any subsequent renewal period.
      3. To cancel a subscription: If you do not want your subscription to renew automatically, or if you want to change or terminate your subscription, you must log in to your External Service Account and follow instructions to manage or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the App from your device. For example, if you subscribed using your Apple ID, cancellation is handled by Apple, not SureShot. To cancel a purchase made with your Apple ID, go to Settings > iTunes & App Stores > [click on your Apple ID] > View Apple ID > Subscriptions, then find your SureShot subscription and follow the instructions to cancel. You can also request assistance at https://getsupport.apple.com.
      4. Similarly, if you subscribed on Google Play, cancellation is handled by Google. To cancel a purchase made through Google Play, launch the Google Play app on your mobile device and go to Menu > My Apps > Subscriptions, then find your SureShot subscription and follow the instructions to cancel. You can also request assistance at https://play.google.com. If you cancel a subscription, you may continue to use the canceled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.
      5. If you initiate a chargeback or otherwise reverse a payment made with your External Service Account, SureShot may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a SureShot subscription. In the event that your chargeback or other payment reversal is overturned, please contact SureShot’s customer care. SureShot will retain all funds charged to your External Service Account until you cancel your subscription through your External Service Account.
      6. Certain users may be entitled to request a refund. See section 6.6 below for more information.
    5. INTERNAL SERVICE PURCHASES AND SUBSCRIPTIONS: Internal Purchases, including subscriptions, are processed using the Payment Method you provide on the Website or App. Subscriptions automatically renew until you cancel.
      1. If you make an Internal Purchase, you agree to pay the prices displayed to you for the services you've selected as well as any sales or similar taxes that may be imposed on your payments (and as may change from time to time), and you authorize SureShot to charge the payment method you provide (your "Payment Method"). SureShot may correct any billing errors or mistakes even if we have already requested or received payment. If you initiate a chargeback or otherwise reverse a payment made with your Payment Method, SureShot may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a SureShot subscription. In the event that your chargeback or other payment reversal is overturned, please contact customer service at support@sureshot.video.
      2. If your Internal Purchase includes an automatically renewing subscription, your Payment Method will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for the price and time period you agreed to when subscribing, until you cancel.
      3. To cancel a subscription, log in to the Website or App and go to the Account section. If you cancel a subscription, you may continue to use the canceled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.
      4. You may edit your Payment Method information by using the Settings tool and following the link to let your upgrade expire. If a payment is not successfully processed, due to expiration, insufficient funds, or otherwise, you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates.
      5. In addition, you authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider of your chosen Payment Method. See section 6.6 below for more information.
      6. Event Maker Accounts may choose the option to be invoiced instead of paying with a credit card.
      7. In this case the business will place an order by logging on to the Website or App and placing the order when choosing a payment method.
      8. The service or product will be available once the order has been placed.
      9. Payment terms will be no longer than 7 days.
    6. REFUNDS: Generally, all purchases are nonrefundable.
      1. Special terms apply in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin, and the EU, EEA, UK, and Switzerland.
      2. Generally, all purchases are final and nonrefundable, and there are no refunds or credits for partially used periods, except if the laws applicable in your jurisdiction provide for refunds.
      3. For subscribers residing in the EU, EEA, UK, and Switzerland: In accordance with local law, you are entitled to a full refund during the 14 days after the subscription begins. Please note that this 14-day period commences when the subscription starts.
      4. For subscribers residing in Germany:You may terminate your subscription after it has renewed with a notice period of one month. Your right to terminate for cause remains unaffected.
      5. For subscribers residing in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin, and Israel: Your Right to Cancel - You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. In the event that you die before the end of your subscription period, your estate shall be entitled to a refund of that portion of any payment you had made for your subscription which is allocable to the period after your death. In the event that you become disabled (such that you are unable to use our services) before the end of your subscription period, you shall be entitled to a refund of that portion of any payment you had made for your subscription which is allocable to the period after your disability by providing SureShotnotice in the same manner as you request a refund as described below.
    7. Purchases of virtual items are FINAL AND NON-REFUNDABLE.
    8. If any of the above apply to you and you subscribed using your Apple ID, your refund requests are handled by Apple, not SureShot. To request a refund, please contact your External Service directly; for example using your Apple device, go to Settings > iTunes & App Stores > [click on your Apple ID] > View Apple ID > Purchase History. Find the transaction and select "Report a Problem." You can also request a refund at https://getsupport.apple.com. For any other purchase, please contact SureShot customer service with your order number (see your confirmation email) by mailing or delivering a signed and dated notice which states that you, the buyer, are canceling the agreement with SureShot, or words of similar effect.

  7. Account Termination
    1. If you no longer wish to use our services, or if we terminate your Account for any reason, here's what you need to know. You can delete your Account at any time by logging into the App, going to the “Profile” tab, and selecting “Settings” (the gear icon), and following the instructions to terminate your membership. However, you will need to cancel / manage any External Service Purchases through your External Service Account (e.g., App Store, Google Play) to avoid additional billing.
    2. SureShot reserves the right to investigate and, if appropriate, suspend or terminate your Account without a refund if SureShot believes that you have violated these Terms, misused our services, or behaved in a way that SureShot regards as inappropriate or unlawful, on or off our services. We reserve the right to make use of any personal, technological, legal, or other means available to enforce the Terms, at any time without liability and without the obligation to give you prior notice, including, but not limited to, preventing you from accessing the services.
    3. If your Account is terminated by you or by SureShot for any reason, these Terms continue and remain enforceable between you and SureShot, and you will not be entitled to any refund for purchases made. Your information will be maintained and deleted in accordance with our Privacy Policy
    4. EVENT CREATOR ACCOUNT TERMINATION

      • If you are an event creator and you are terminating your account you will no longer be able to access any content that has been created.
      • All event data and event content created by users will be transferred to SureShot.

  8. User complaints
    1. Complaints should be submitted through the help center in the Account section of the App before taking any other action. You must include the reason you are unsatisfied and any other information reasonably requested by us. After receiving the complaint, we will process the complaint in accordance with our internal complaint practices and when needed in cooperation with the Event Maker. These Terms do not limit the means otherwise available to you to resolve any dispute you have with the Event Maker under applicable law.

  9. Your responsibilities
    1. We can’t cover everything here but we’ve highlighted a few areas that are an important part of your relationship with SureShot. As you use our App keep in mind, you are always responsible for the activity that occurs on your Account, and are required to notify us immediately of any change in your eligibility to use or access the App, or any breach of security or unauthorized use of your Account.
    2. As a condition to use the App and access your Account you are required to comply with all laws and regulations that apply to you at all times in connection with your use of the Platform.
    3. Your behavior. You are expected to follow the guidelines given by the Event Maker and SureShot in terms of video recording.
    4. SureShot rules of conduct. When using the App and accessing your Account you acknowledge that you are responsible for all of your activity in connection with the Platform which includes your acknowledgment and agreement with the following:
      1. To not use the Platform for any illegal purpose or any other purpose that is prohibited by these Terms.
      2. You are the age of majority (legal age) in your local jurisdiction.
      3. You will not engage in inappropriate behavior towards other members or Event Makers.
      4. You’re not located in a sanctioned country or on a sanctioned persons list.
      5. You acknowledge and agree that you have not created other SS Accounts that have been suspended or terminated by SureShot for violations of our terms, policies, or applicable laws or regulations.
      6. You will not use any automated systems, robots or software to extract data from the Platform.
      7. You will not (nor permit any third party to) (a) take any action; nor (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any content on or through the Platform that: (i) you know is false, misleading, untruthful or inaccurate; (ii) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party; (iii) impersonates any person or entity; or (iv) includes anyone’s identification documents or sensitive financial information.
      8. You will not: (i) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Platform or any activities conducted on the Platform; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Platform (or other accounts, computer systems or networks connected to the Platform); (iv) run any form of auto-responder or “spam” on the Platform; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Platform; or (vi) harvest or scrape any content from the Platform.
      9. You will not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Platform (including without limitation any application), except to the limited extent applicable laws specifically prohibit such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Platform; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder.
      10. You will abide by all applicable laws and regulations in connection with your use of the Platform.
      11. You will not access or use the Platform if you are a direct competitor, or an agent of SureShot’s direct competitor, except with SureShot’s express prior written consent.
      12. You will not access the Platform for any commercial purposes (including for the purposes of copying or reproducing any material or content on the Platform, monitoring the availability, performance or functionality of the Platform, or for any other benchmarking or competitive purposes).

  10. Data use and privacy
    1. SureShot values your privacy and works to ensure that it’s protected when using our Platform. When you use the Platform we collect and process personal data about you. You can read more about how we collect and use personal data in our Privacy Policy.

  11. Indemnity and Limitation of Liability
    1. You agree to indemnify, defend and hold harmless SureShot and its parents, subsidiaries and affiliates, along with their directors, officers, employees and contractors from and against any and all claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to your: (i) use of the Platform; (ii) breach of these Terms; and (iii) violation of applicable law or regulation.
    2. SureShot shall not be liable for any losses or damages arising out of or in connection with the following: (i) your use of the Platform; (ii) content of sites to which the Platform links; and (v) circumstances outside of SureShot’s control.
    3. To the maximum extent permitted by law, SureShot shall not be liable for indirect or consequential damages. To the maximum extent permitted by law, SureShot shall not be liable for any damages exceeding the amounts SureShot collected from you excluding external costs in the 12 months preceding the first event that gave rise to your claim.

  12. Intellectual property
    1. The Platform and the services we offer via the App, including all underlying technology, software, graphics, designs and all copyrights, trademarks, service marks, trade names, logo and other intellectual property or proprietary rights contained therein, are and remain our sole and exclusive property except for content owned by third parties who have authorized SureShot to display content. Except as expressly set forth in these Terms, no license or any other right is granted to you.
    2. By using the Platform, you agree not to copy, distribute, modify, or make derivative works of any content without our prior written consent. The Platform nor any part of the Platform may be reproduced or stored in any other system or platform or included in any public or private electronic retrieval system or service, without SureShot’s prior written permission.
    3. Feedback. If you provide ideas or suggestions regarding the Platform, advertising or promotions, additions to our services or changes in methods of doing business (“Feedback”) we are free to fully exploit such Feedback. You understand and acknowledge that we shall exclusively own all known or hereafter existing rights to the Feedback everywhere in the world, and that such Feedback is hereby irrevocably assigned to us. Without limiting the foregoing, to the extent any such assignment is deemed unenforceable, and to the extent necessary for SureShot to use the Feedback, you hereby grant SureShot an irrevocable, perpetual, world-wide license to use the Feedback and any associated intellectual property in any manner, in any medium now known or hereafter developed, without restriction or payment to you.

  13. Suspension and termination
    1. We are entitled to suspend or terminate your access to the Platform including the deletion of your Account at any time at our reasonable discretion without any liability. Examples of scenarios where this may happen are:
      1. You materially or repeatedly breach these Terms.
      2. We’re required to do so to comply with a legal requirement or a court order.
      3. We reasonably believe that your conduct causes harm or liability to us, an Event Maker, member, or third party – for example, by hacking, phishing, harassing, spamming, misleading others or scraping content that doesn’t belong to you.
      4. In our discretion we think you have acted in a manner that is abusive or disrespectful to a SureShot employee, agent, partner, user, or other SureShot customer.
      5. You’re located in a sanctioned country or are on a sanctioned persons list.
      6. You're inactive on the App for an extended period of time.
      7. You create or attempt to create a new Account after suspension or termination of another SureShot Account.
    2. We encourage you to contact us, if you believe that your Account has been suspended or terminated in error.

  14. Event Maker Accounts reference
    1. For any Event Maker Account approved SureShot are allowed to display logos and business names on the SureShot website, sales and marketing material and other promotional material.
    2. Unless otherwise agreed, SureShot may use snippets of the content published during the event for its own marketing purposes, like social media clips, case videos and more.

  15. Miscellaneous
    1. No Warranties. The Platform is made available to you on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including any implied warranties of non-infringement, merchantability and fitness for a particular purpose unless you’re located in an area that by law provides you a specific right contrary to this disclaimer or does not permit us to exclude a warranty. Otherwise, we’re held to only the express promises we make to you in these Terms.
    2. Blocking your access or refusing to process a payment. Our App is available for use in many countries throughout the world so different laws may apply in different countries that concern our relationship with you. We may block your access, terminate your Account, or refuse to process a payment if we reasonably believe there’s a risk - like a potential breach of a law or regulation - associated with you or a payment. We may take any of these actions without notice. Examples of where we might do this include:
      1. Transactions where we can’t receive payments from you, your bank or your country.
      2. Payments from sanctioned persons or persons located in sanctioned countries.
      3. Where we reasonably believe there is a legal or regulatory issue.
    3. Changes to these Terms. We can make changes to these Terms at any time. If we update these Terms we will notify you in your Account and post them on the Platform. The new Terms will not apply retrospectively to your use of our Platform before the Terms changed, but the new Terms will apply to your continued use of the Platform and your Account after the effective date of the new Terms. Your continued access to or use of the Platform or your Account will constitute acceptance of the revised Terms. If you do not wish to continue using the Platform following the changes to the Terms, you can cancel your agreement to the Terms by deleting your Account.
    4. Third Parties. You understand and acknowledge that SureShot does not provide, endorse, or guarantee any third party product, service or information on the App. The Platform may contain links to other websites not maintained by us. Other websites and apps may also reference or link to our Platform. We encourage you to be aware when you leave our Platform and to read the terms and conditions and privacy statements of each and every website and app that you visit. We are not responsible for the practices or content of such other websites and apps.
    5. Severability. If any part of the Terms are deemed unlawful, void or for any reason unenforceable, you agree that any such provision will be modified to carry out the original intent to the fullest extent permitted by law. If modification is not possible then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.
    6. Waiver and Remedies. No failure or delay by SureShot to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.
    7. Contracting Parties, Applicable Law and Venue. We’ve set out the SureShot entity you contracted with in section 2.1 based on your location. These Terms will be interpreted in accordance with the laws of the location you attend events and use the SureShot App regardless of conflict of laws rules unless laws applicable in your place of primary residence require other laws to apply. Claims must be brought in the location where you use the SureShot App unless laws applicable to you require another location. Any disputes will be resolved exclusively by the dispute resolution method set out in these Terms.
    8. Resolving Disputes. Most of your concerns can be resolved quickly and to everyone’s satisfaction by contacting us. If we’re unable to resolve your complaint to your satisfaction (or if we haven’t been able to resolve a dispute we have with you after attempting to do so informally), you and we agree to resolve those disputes in the ordinary courts based on the applicable law and venue set out in these Terms and all proceedings will be conducted in English unless local laws or regulations apply that require the proceedings to be conducted in another language.
    9. Depending on your location, you may also seek the help of a consumer ombudsman or non-governmental organizations working on behalf of consumers.

    12. Class Action Waiver. You agree that any claim or proceeding arising from these Terms must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding which any related rights you hereby waive unless prohibited by law.
    13. Jury Trial Waiver. You and we acknowledge and agree that we each waive the right to a trial by jury.
    14. SureShot reserves the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request; (ii) enforce these Terms, including investigation of potential violations hereof; (iii) detect, prevent, or otherwise address fraud, security or technical issues; (iv) respond to user support requests; or (v) protect the rights, property or safety of us, our users and the public.
